What Is a Qualified Domestic Relations Order (QDRO)?

Dividing retirement benefits can be one of the most technical and overlooked parts of a divorce. A Qualified Domestic Relations Order (QDRO) is a court-approved document that instructs a retirement plan administrator how to divide certain types of retirement accounts between former spouses.

A properly prepared QDRO ensures that the division follows both federal regulations under ERISA and the rules of the retirement plan itself. It also helps avoid unnecessary taxes or penalties that might otherwise apply when funds are transferred.

What Does a QDRO Do?
A QDRO establishes the rights of an alternate payee—usually a former spouse—to receive a share of the participant’s retirement benefits. It tells the plan administrator:
• How much or what percentage of the account should be assigned• When and how payments should be made • Whether benefits will be transferred to another qualified account, such as an IRA
Without a QDRO, the division of retirement benefits in a divorce decree cannot be carried out by the plan.

Which Retirement Accounts Require a QDRO?
A QDRO applies to qualified retirement plans covered by the Employee Retirement Income Security Act (ERISA), such as 401(k) and 403(b) plans, and defined-benefit pension plans.
Other types of accounts—like IRAs or federal Thrift Savings Plan (TSP) accounts—follow different but similar procedures. For example, dividing a TSP account requires a Retirement Benefits Court Order (RBCO) instead of a QDRO, though the intent and process are comparable.

How the QDRO Process Works
1. Drafting the Order – The QDRO is prepared based on the terms of the divorce judgment or settlement agreement.
2. Pre-Approval (if allowed) – Some plan administrators review the draft before the court signs it to ensure compliance. 3. Court Approval – The signed order is entered by the court. 4. Plan Submission – The finalized order is sent to the plan administrator for review and implementation.
